When the ATO audits an SMSF auditor … what to expect and how to best prepare

DBA Lawyers has advised and represented numerous SMSF auditors who are being audited by the ATO and ASIC.

On Wednesday 12 April 2023, Bryce Figot of DBA Lawyers will present an exclusive webinar on what to expect from ATO audits and how to best prepare for them.

If all goes well in an ATO audit of an SMSF auditor, the ATO may close their file. However, if the ATO is not satisfied, the ATO might refer the auditor to ASIC. ASIC then has the power to impose various different outcomes, including public disqualification, suspension or imposing conditions on the auditor’s registration.  Accordingly, there is tremendous importance in satisfying the ATO’s inquiries thoroughly and properly in a timely manner.

DBA Lawyers have picked up various practical ‘tips’ and ‘traps’ while working for SMSF auditors being audited by the ATO over the years. We feel these tips and traps could prove invaluable for ALL SMSF auditors.

With this knowledge, an SMSF auditor will be far better placed to promptly deal with an ATO review or audit.

Some of the tips and traps might seem obvious but are well worth repeating so they are not overlooked.

Other tips and traps are far less intuitive, yet can prove critical.

These tips and traps cover:

  • What we suspect triggers an ATO audit
  • What SMSF auditors should be doing NOW … long before any ATO audit
  • What prompt action you should take when first alerted to an ATO review or audit of your audit files
  • Key issues and ATO interpretation of the law
  • Most common areas where auditors come ‘unstuck’
  • Much more …
